Can we please cut through all the legal guano here? Get a piece of paper and draw a timeline. How, pray tell, if ObamaCare is magically discovered a tax, is it being argued before the SCOTUS three years ahead of completion of its infernal gestation?
He has a point. Not that it matters, because John Roberts hath decreed "tax," and lo, a tax it is.
Until it's a penalty again.
White House Press Secretary Jay Carney said Friday the fine is still just a "penalty."
Calling it a "tax" causes obvious political problems for the White House. Obama fought that label vigorously when selling the bill in 2009.
"It's a penalty, because you have a choice. You don't have a choice to pay your taxes, right?" Carney said.
You don't really have a choice about paying that "penalty" either, but hey, let's not quibble over semantics.
Pay is the operative word here.
Whatever we call it, we still gotta write the check.
There's only one way to avoid that eventuality. Repeal.
It's what the people want. Seeing as how SCOTUS no longer believes it is their job to "protect the people from the consequence of their political choices" I guess the people should always get what they want.
Even if they want Barabbas.
So I have a question for my rejoicing liberal friends. If "the people" now make a "political choice" to enact prayer in schools, will SCOTUS still "protect" us from those consequences?
You don't have to answer. But try not to tie yourselves in knots with your non-existent "separation of church and state" clause, OK?
