Six same-sex couples today will ask the New Jersey Supreme Court to allow gays to marry, their attorney said.
"Second-class status isn't marriage. That's why we're returning to court," said Hayley Gorenberg, deputy legal director for Lambda Legal, which is filing the motion asking the state's highest court to revisit the matter of gay marriage.
The Supreme Court ruled in 2006 in Lewis vs. Harris that committed same-sex couples deserve the same rights and obligations as married people. Later that year, state lawmakers legalized civil unions, which were to confer all the benefits of marriage on same-sex couples without using the term "marriage."
But gay and lesbian couples and advocacy group Garden State Equality have said the civil union law has not worked and they continued to seek a law giving them the right to marry.
Sigh. The public has rejected gay "marriage" time and again. The New Jersey legislature held an up-or-down vote on the matter in January. It went down in flames.
These guys can't take "no" for an answer. So they're petitioning the most liberal, activist State Supreme Court in the universe to invent a "right" to same-sex marriage.
The sad thing is that they'll probably succeed.
The seven unelected Justices on our Supreme Court have no qualms about crafting new social policy out of whole cloth and using specious inferences derived from willful disregard for the clear letter of the law to do it.
Our State Constitution specifies that public education must be provided for children between the ages of 5 and 18. So naturally that implies children aged 3 and 4 deserve free pre-school too. Their ruling said taxpayers must fund glorified babysitting simply because social justice activists demanded it.
The State Constitution requires all bonding or borrowing "in any manner" by the government must be put to a referendum before the voters. But in our State Supreme Court's wisdom "in any manner" doesn't apply to bonds issued by state agencies or quasi-independent authorities. Why? Because the bonds in question were being used to finance school construction, another social program dictated by judicial fiat.
So even though the civil union law provides for every legal benefit of marriage sans the nomenclature itself I'm almost certain the judicial activists on the Court will override the democratically held vote of the people's representatives.
It all hinges on the chimera of hospital visitation:
Same-sex couples "are blocked from seeing their loved ones during medical emergencies; their state-designated status confuses medical providers, especially in times of crisis," the court papers say.
Utter rubbish. Complete nonsense. By now everyone knows what a civil union is. If they don't, print up some little index cards and hand them out. Every cause under the sun promotes "awareness". So get out there and promote some awareness of civil unions.
Here's the thing. If some jackass is so cold-hearted that he won't allow two dudes to be together in their hour of medical crisis what makes anyone believe that he'll suddenly relent if those dudes say that they're "married"?
Officious jerks will always be officious jerks regardless of marital or familial status. When my mother-in-law was dying last year the asshole nurse on her ward played the "immediate family only" card. So her brother was allowed in, but his daughter who was actually her primary caregiver (as well as my daughter who wanted to say goodbye to her grandma) got left out in the cold. I guess they need a law too!
Same-sex couples already have all the legal protections they need to live happily ever after. Up-ending the sacred institution of marriage won't garner them any new "rights". But it will shatter 6,000 years of tradition and rend the fabric of our state's religious establishment.
And I fear that really is the goal of same-sex "marriage" advocates. Not to improve their own lot, but to destroy the traditional underpinnings of our society. As Robert Stacy McCain famously said:
"The gay-rights crowd won't be satisfied until homosexuality is compulsory, with penalties for non-participants."

Well, they're "sorta, kinda" indexing me anyway. It's on a 24 hour tape delay or something. So I never get picked up by Memeorandum because they pull from Technorati and Technorati has stuff I posted yesterday listed as my latest blog entry. And that's old news to Memeorandum.
